Welcome to simplefastmoney.com, including any linked subdomains, mobile applications, and connected online services (collectively, the "Site"). The Site is owned and operated by Atlantic Finance Corporation, d/b/a Simple Fast Money, a Delaware corporation with its principal place of business at 5900 Balcones Drive, #22963, Austin, TX 78731 ("Simple Fast Money," "SFM," "Company," "we," "our," or "us").
These Terms govern your use of the Site and any of the products and services made available through the Site (the "Services"). Simple Fast Money is a Credit Access Business (CAB) licensed by the Texas Office of Consumer Credit Commissioner (OCCC License No. 2500080154-174268). We arrange short-term installment loans on your behalf with an unaffiliated third-party lender, G4 Funding LLC. We are not the lender. Your compliance with these Terms is a condition of your use of the Site and Services. By using our Site or applying for a Service, you agree to these Terms and to our Privacy Notice. These Terms constitute a legal contract between you and SFM governing your use of the Site and Services, to the extent not superseded by the terms of any loan agreement, credit services agreement, or other written contract we enter into with you. See Section 17 (Additional Terms) for more information.
We may, from time to time, make modifications, changes or additions to these Terms. Your continued use of the Site or Services after the posting of any changes constitutes your acceptance of those changes. You should visit this page periodically to review any changes. The "Last Updated" date at the top of these Terms indicates when the current version became effective.
The Services are not available to persons under 18 years of age or to persons who are not legal residents of the United States. To be eligible to apply for a loan arranged by Simple Fast Money, you must:
BY USING THE SITE OR APPLYING FOR OR USING ANY OF THE SERVICES, YOU REPRESENT AND WARRANT THAT YOU MEET THE ELIGIBILITY REQUIREMENTS ABOVE. Not all Services are available in all geographic areas. Your eligibility for particular Services is subject to final determination by SFM and the third-party lender.
Notice to members of the Armed Forces and their dependents. Federal law provides important protections to active-duty members of the Armed Forces and their dependents. Simple Fast Money does not offer credit products that comply with the Military Lending Act's 36% Military Annual Percentage Rate (MAPR) cap, and we do not extend credit to covered borrowers as defined by the Military Lending Act.
While you may browse certain parts of the Site without registering, certain functions require you to register and create a username and password. You may not share your username or password with anyone. You are solely responsible for (i) authorizing, monitoring, and controlling access to your username and password and maintaining their confidentiality, (ii) informing us in writing of any need to deactivate a username due to security or confidentiality concerns, and (iii) any charges or damages incurred by use of your username and password until such time as you notify us that the account has been compromised or otherwise misused. We are not liable for any harm arising from any authorized or unauthorized use of your username or password.
We collect information you provide to us (for example, when you create or modify your account, apply for a loan, contact customer support, or otherwise communicate with us), information we collect automatically (such as device, location, and Internet Protocol (IP) address), and information collected through cookies, web beacons, analytics tools, and similar technologies.
For complete information on what we collect, how we use and share it, how we protect it, and how you can opt out of certain sharing, please review our Privacy Notice. The Privacy Notice is incorporated into and made part of these Terms.
We use cookies and similar technologies to operate the Site, understand how visitors use it, and (with your consent) deliver interest-based advertising. You can manage your cookie preferences through the cookie banner on the Site or your browser settings. The Site recognizes the Global Privacy Control (GPC) signal where required by law.
You acknowledge that use of a username and password is an adequate form of security and that Internet transmissions are never completely private or secure. Any message or information you send to the Site may be read or intercepted by others, despite our efforts to protect such transmissions. As a condition of your use of the Site, you agree that you will not take any action intended to: (i) access data not intended for you; (ii) invade the privacy of, obtain the identity of, or obtain any personal information about any SFM customer or Site user; (iii) probe, scan, or test the vulnerability of the Site or SFM's network or breach security or authentication measures without authorization; (iv) attempt to interfere with service to any user, host, or network or otherwise disrupt our business, including by submitting a virus, overloading, "flooding," "spamming," "mail bombing," or "crashing"; or (v) send unsolicited mail, promotions, or advertising. Violations of system or network security may result in civil or criminal liability.
We use industry-standard physical, technical, and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, because the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. It is your responsibility to protect the security of your login information. E-mails and other communications you send to us through the Site are not encrypted.
By submitting your contact information, registering for an account, or applying for or beginning an application for a Service, you expressly consent to be contacted by us by telephone (including calls placed with prerecorded or artificial voice messages and automatic telephone dialing systems), text message, email, or postal mail at any number, email address, or mailing address we have for you in our records, even if such number is on the federal or any state Do Not Call List, for matters related to your loan or application, including reminders, servicing, collections, and related issues. Where allowed by law, we may also contact other individuals who may be able to provide updated employment, location, or contact information for you.

The Site is protected by United States and international copyright and trademark laws and other applicable intellectual property laws. All content, files, code, documents, text, photographs, images, audio, video, and other materials accessed through or made available on the Site (collectively, the "Content") are the property of Atlantic Finance Corporation, d/b/a Simple Fast Money or its licensors. The Content may not be copied, distributed, modified, reproduced, published, or used, in whole or in part, except for purposes authorized in writing by SFM. You may not frame or use framing techniques to enclose, or deep-link to, our names, trademarks, service marks, logos, Content, or other proprietary information without our express written consent.
You are authorized solely to view and retain a copy of the pages of the Site for your own personal, non-commercial use. You agree not to (i) remove or alter any trademark or proprietary notice displayed on the Site or on printed pages produced from the Site, or (ii) make any modifications to documents obtained from the Site other than those required to complete a transaction with SFM.
If you submit any comments, ideas, suggestions, information, files, images, or other materials to us or post them to the Site, or if you submit any materials through third-party services (for example, by tagging us on social media) (collectively, "Submissions"), you represent and warrant that you own or have the necessary rights and licenses to provide them. You grant SFM a royalty-free, irrevocable, perpetual, and fully transferable right and license to use the Submissions at our discretion and to use your name as provided in connection with your Submission. Do not provide Submissions that (i) are abusive, unlawful, obscene, or harmful or that could encourage criminal or unethical behavior; (ii) violate or infringe the intellectual property or privacy rights of any person or entity; or (iii) contain or transmit a virus or any other harmful component. SFM takes no responsibility for Submissions and is not subject to any obligation of confidentiality regarding them except as expressly agreed in writing or required by law.

Each Promotion may have additional terms or rules of participation ("Promotion Rules"), which will be posted or otherwise made available to you. The foregoing limitation applies to the extent permitted by law in the applicable jurisdiction.
You agree to defend, indemnify, and hold harmless SFM, its affiliates, and their respective directors, officers, employees, agents, contractors, successors, and assigns from and against all third-party claims, damages, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or violation of applicable law, any of your Submissions, your use of or access to the Site, or access by anyone using your account. We reserve the right to assume or participate, at your expense, in the investigation, settlement, and defense of any such action or claim.
Certain features or Services available through the Site may be subject to additional terms, including without limitation a Credit Services Agreement, a Promissory Note with the third-party lender, a Cost Disclosure, an Electronic Fund Transfer (ACH) authorization, and our SMS Terms & Conditions and Privacy Notice. Where any additional terms conflict with these Terms, the additional terms govern solely with respect to those features or Services. Such additional terms are expressly incorporated into and made part of these Terms.
The Site and Services are not intended for children under 18 years of age. SFM does not knowingly collect, use, or disclose personal data from any child under the age of 18.
Simple Fast Money operates from the State of Texas. These Terms and the relationship between you and SFM are governed by the laws of the State of Texas, without regard to its conflict-of-laws provisions, and (where applicable) by federal law. Except to the extent that disputes are required to be resolved by arbitration under Section 20 below, any action or proceeding relating to any dispute arising out of these Terms or your use of the Site or Services may only be instituted in the state or federal courts located in Travis County, Texas. Both you and SFM consent to the exclusive personal jurisdiction and venue of those courts.
THIS ARBITRATION SECTION DOES NOT APPLY IF (1) YOU ARE A MEMBER OF THE ARMED FORCES OR A DEPENDENT OF SUCH A MEMBER COVERED BY THE FEDERAL MILITARY LENDING ACT AND (2) THE DISPUTE INVOLVES THE EXTENSION OF CONSUMER CREDIT. THIS SECTION INCLUDES A CLASS-ACTION WAIVER. PLEASE READ IT CAREFULLY.
Certain portions of this Section are deemed to be a "written agreement to arbitrate" pursuant to the Federal Arbitration Act. You and SFM agree that this Section satisfies the "writing" requirement of the Federal Arbitration Act. This Section can only be amended by mutual written agreement.
If any controversy, allegation, or claim arises out of or relates in any way to the Site, the Services, Content, Submissions, or these Terms (collectively, a "Dispute"), excluding any claims relating to SFM's actual or alleged intellectual property rights or any claims for injunctive relief described in Section 20.5 below (an "Excluded Dispute"), then both you and SFM agree to send a written notice to the other providing a reasonable description of the Dispute or Excluded Dispute, along with a proposed resolution. For 60 days from the date of receipt of notice, the parties will engage in a dialogue to attempt to resolve the Dispute, though nothing requires either party to resolve the Dispute on terms with which it is not comfortable.
If a Dispute is not resolved within 60 days, then either party may submit the Dispute to formal arbitration. The Dispute will be resolved solely by binding arbitration in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association ("AAA"). If the Dispute has a claimed value of not more than $250,000, it will be heard by a single neutral arbitrator who is a retired judge or a lawyer with not less than 15 years' experience as a practicing member of the bar in the substantive practice area related to the Dispute, who will administer the proceedings in accordance with the AAA's Supplementary Procedures for Consumer-Related Disputes. If the Dispute has a claimed value of more than $250,000, or if SFM elects, in its sole discretion, to bear the costs of a three-member panel, then the arbitration will be heard by a three-member panel.

In arbitration, the arbitrator must honor these Terms and can award the prevailing party damages and other relief (including attorneys' fees). However, WITH ARBITRATION (A) THERE IS NO JUDGE OR JURY, (B) THE ARBITRATION PROCEEDINGS AND OUTCOME ARE SUBJECT TO CERTAIN CONFIDENTIALITY RULES, AND (C) JUDICIAL REVIEW OF THE ARBITRATION OUTCOME IS LIMITED. All parties to the arbitration have the right, at their own expense, to be represented by an attorney or other advocate of their choosing. If an in-person arbitration hearing is required, it will be conducted in the metropolitan statistical area where you are a resident at the time the Dispute is submitted to arbitration.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE MUST BE FILED WITHIN ONE YEAR AFTER THE DISPUTE AROSE OR IT WILL BE FOREVER BARRED.
The provisions of this Section do not apply to (i) legal action taken by SFM to seek an injunction or other equitable relief in connection with any loss, cost, or damage (or potential loss, cost, or damage) relating to the Site, Services, Content, Submissions, or SFM's intellectual property rights, or (ii) qualifying claims brought in small claims court, subject to the venue provisions of Section 19.
DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS AND WILL NOT BE CONSOLIDATED WITH ANY OTHER ARBITRATION OR PROCEEDINGS INVOLVING ANY CLAIM OR CONTROVERSY OF ANY OTHER PARTY. YOU AND ATLANTIC FINANCE CORPORATION EACH WAIVE THE RIGHT TO PARTICIPATE AS A REPRESENTATIVE, PLAINTIFF, OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION AGAINST THE OTHER. If, for any reason, a court of competent jurisdiction or an arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate will not apply and the Dispute must be brought exclusively in court under Section 19.

Any failure by SFM to exercise any rights or enforce any of these Terms does not constitute a waiver of such rights or Terms. If any provision of these Terms or its application in a particular circumstance is held to be invalid or unenforceable to any extent, the remainder of these Terms, or the application of such provision in other circumstances, shall not be affected, and each provision shall be valid and enforced to the fullest extent permitted by law. These Terms constitute the entire agreement between you and SFM with regard to your use of the Site, Services, or Content, and supersede all prior or contemporaneous written or oral agreements between you and SFM regarding such use. SFM will not accept any counter-offers to these Terms, and all such offers are hereby rejected.
The Site, the Services, and the Content are directed to persons residing in the United States and, with respect to credit Services, to residents of Texas. You may not use, export, or re-export any portion of the Site, Services, or Content in violation of any applicable laws or regulations, including U.S. export laws and regulations.
